Terms of Service and Usage Conditions

This Terms of Service (“Agreement”) is entered into between Fios Yazılım Sanayi Ticaret Anonim Şirketi (“Company”) and the natural or legal person (“User”) using the Bildirt platform.

User:
Any individual or entity registered to the Bildirt platform and benefiting from the services.

2. Subject

This Agreement governs the terms of use and the rights and obligations of the parties regarding the services provided under the Bildirt brand, including Web Push Notifications and Cookie Management Platform (CMP).

3. Scope of Service

Bildirt is a SaaS (Software as a Service) platform that enables users to send push notifications and manage cookies/consents for their own websites or digital platforms.

Services may be offered under free and paid plans. Free plans may have limited features.

4. Membership and Account Security

  • The User agrees that the information provided during registration is accurate and complete.
  • The User is responsible for maintaining the confidentiality and security of their account credentials.
  • In case of suspected unauthorized use, the Company reserves the right to temporarily suspend the account.

5. Pricing and Payment

  • Services may be billed on a monthly, semi-annual, or annual basis.
  • Unless otherwise stated, payments are collected in advance.
  • Subscriptions are automatically renewed.
  • The subscription continues under the same terms unless canceled before the renewal date.

6. Subscription Cancellation

  • The User may cancel the subscription via the panel or by email.
  • Cancellation becomes effective at the end of the current billing period.
  • Access to services will terminate at the end of the period following cancellation.

7. Right of Withdrawal

Since the services provided by Bildirt are digital services and performance begins immediately, the User acknowledges that the right of withdrawal may fall under legal exceptions in accordance with applicable legislation.

8. Prohibited Uses

The User may not use the platform for:

  • Illegal content or activities
  • Spam, misleading, or unauthorized communications
  • Distributing malware or attempting security breaches
  • Violating the rights of third parties

In such cases, the Company reserves the right to suspend the service or terminate the Agreement unilaterally.

9. Data and Privacy

  • Push notification tokens are not designed to directly identify individuals.
  • Cookie and personal data processing activities are governed by the Privacy Policy and Cookie Policy.
  • Servers may be located in Turkey and/or within the European Union.

10. Limitation of Liability

The Company does not guarantee that the service will be uninterrupted or error-free.
The Company shall not be liable for indirect damages, data loss, or loss of profits.

11. Suspension of Service

The Company may temporarily suspend the service due to maintenance, security reasons, performance improvements, or legal obligations.

12. Amendments to the Agreement

The Company reserves the right to amend this Agreement.
The updated version enters into force on the date it is published on the website.

13. Governing Law and Jurisdiction

This Agreement shall be governed by the laws of the Republic of Turkey.
Nevşehir Courts and Enforcement Offices shall have jurisdiction in case of disputes.

14. Effectiveness

By registering to the Bildirt platform or using the services, the User declares that they have read, understood, and accepted this Agreement.
